1. General information

These Terms & Conditions (the “Terms”) govern the use of Habify (the “Service”), owned by [NOMBRE / RAZÓN SOCIAL] ([NIF / CIF]). By registering or using the Service you accept these Terms, the Legal Notice, the Privacy Policy and the Cookie Policy.

2. Description of the Service

Habify is a shared-living organisation tool that lets flatmates split household tasks and keep an informational record of shared expenses. Habify is not a payment, financial, banking or collection service: it does not process or transfer money. Amounts, balances and settlements are purely informational calculations based on what you and your flatmates enter, and do not constitute proof of debt or advice of any kind. Any actual payment between users happens outside the Service and under their sole responsibility.

3. Requirements and account

• You must be over 18 years old and have legal capacity to accept these Terms.
• You must provide accurate information and keep it up to date.
• You are responsible for the confidentiality of your credentials and for all activity under your account.
• You must notify us of any unauthorised use of your account.

4. Acceptable use

You agree not to: (a) use the Service for unlawful or fraudulent purposes; (b) submit offensive, defamatory or infringing content; (c) gain unauthorised access to accounts, homes or systems; (d) interfere with, overload or circumvent the security of the Service; (e) use it to send spam or unsolicited invitations.

5. Homes and user content

The Service is organised into “homes” with several members. The content you contribute (tasks, expenses, notes, member names) is your responsibility and will be visible to other members of the home. You retain ownership of your content and grant us a limited licence to host and display it solely to provide the Service. You are responsible for having the necessary legitimacy to record other people’s data (e.g. account-less flatmates).

6. Notifications

The Service may send you communications by email and, if you enable them, push notifications related to your activity (tasks, expenses, reminders). You can manage your preferences or disable them at any time in settings.

7. Availability and price

The Service is currently offered free of charge and “as is”. We may modify, suspend or discontinue the Service in whole or in part, and may introduce paid features in the future, giving you reasonable notice where appropriate.

8. Intellectual property

The software, design, trademark and content of the Service belong to the owner or its licensors. No rights over them are granted to you other than the right to use the Service in accordance with these Terms.

9. Suspension and termination

You may stop using the Service and delete your account at any time from your profile. We may suspend or terminate your access if you breach these Terms or the law, or where necessary to protect the Service or other users.

10. Disclaimer and liability

The Service is provided without warranties of uninterrupted availability, freedom from errors or fitness for a particular purpose. To the fullest extent permitted by law, the owner shall not be liable for indirect damages, loss of profit or loss of data arising from use of the Service, nor for disputes, calculations or payments between users. Nothing in these Terms excludes liability that cannot lawfully be limited, in particular towards consumers.

11. Changes to the Terms

We may update these Terms. We will publish the current version on this page and, if changes are material, notify you by reasonable means. Continued use of the Service after an update constitutes acceptance.

12. Applicable law and jurisdiction

These Terms are governed by Spanish law. If you act as a consumer, you may bring proceedings before the courts of your domicile and are protected by mandatory consumer rules; otherwise, the parties submit to the Courts of the owner’s domicile.
